Patent drafting refers to the process of writing the patent description and claims.

The drafting of a patent is carried out considering the statutory requirements for patentability, potential prior art uncovered during search, examiner’s objection and/or opposition that may come up during the prosecution stage, and litigations that the patent may have to go through post grant.

Hence, patent drafting is a technique of delicate balance of disclosure in which the specification drafted should sufficiently avoid teaching prior-art. The patent drafting involves brain-storming with the inventor to suitably understand their novel and inventive point and to reflect the same in the patent’s title, abstract, claims, description and/or drawings.
